A federal judge in Maryland denied a motion to dismiss a lawsuit filed by families who were denied coronavirus checks because their parents were undocumented on Friday. U.S. District Judge Paul Grimm rules that even though the children, who filed the lawsuit on behalf of their parents, aren't receiving the checks - they have been directly harmed by it.
The judge also rejected the government's motion to dismiss the lawsuit on the grounds that it was immune to these kinds of constitutional claims and that families couldn't sue for money damages.
Some have argued that the CARES act, which was signed on March 27, is inherently unconstitutional because the law requires anyone receiving the money to have a social security number to be eligible for the max payment of $1,200 and an additional $500 for each dependent claimed. This requirement singles out undocumented immigrants who aren't authorized to work but can still file taxes using a separate identification number - which congress didn't make eligible for relief funds.
Reporting from Buzzfeed News underlines this argument further:
"The parents at issue paid federal and state taxes, and would otherwise meet the eligibility requirements, according to the lawsuit filed in May in federal court in Maryland. The parents and their kids, who are all named as plaintiffs, argue denying a federal benefit to these children is unconstitutional because they’re being discriminated against and treated differently from other US citizen kids."
This isn't the only group of people suing President Trump and his administration regarding the CARES act. Groups like adult entertainers, business owners with past criminal records as well as lobbyists have sued over not being included in the CARES act. Native Americans have also challenged the government over the funds meant to benefit their communities.
Coupled with recent defeats handed to him by a largely conservative supreme court, Trump sure isn't winning as much as he promised during his first campaign. I'm questioning when he's going to file his own lawsuit against his administration and pretend like he's been an ANTIFA agent this whole time?
